Terms of Service

Plain English: Use Hypertab for legitimate purposes, keep your API keys safe, pay your bill, and don't sue us for the maximum allowed under law. We won't sell or train on your data and we won't lock you in.

1. Acceptance

  • By creating a Hypertab account, calling our API with a Hypertab API key, or using our Model Context Protocol (MCP) server, you agree to these terms and to our Privacy Policy.
  • If you are agreeing on behalf of a company, you represent that you have authority to bind that company.
  • If you do not agree, do not use the service.

2. The service

  • Hypertab provides an "active table" platform: tables, smart columns (AI, HTTP, formula, integration, waterfall, lookup, extract), MCP server, REST API, real-time sync, and webhooks.
  • We may add, modify, or remove features. We will notify customers in advance of changes that materially reduce functionality of paid plans.
  • The service is provided as-is. We aim for high availability but do not guarantee uptime outside of any explicit SLA in your enterprise contract.

3. Your account

  • You are responsible for keeping your password and API keys confidential. Treat API keys like passwords — anyone with one can act as you.
  • You are responsible for all activity under your account, including agent activity initiated by AI tools you connect via MCP.
  • Notify us immediately at [email protected] if you suspect unauthorized access. Rotate compromised keys at app.hypertab.ai/settings/api-keys.
  • One person or one organization per account. Sharing a single login across an organization violates these terms — use unlimited team seats on any paid plan instead.

4. Billing and ops

  • Plans are billed monthly or annually in advance via Stripe. Annual plans save approximately 16% (two months free).
  • One "op" is one row × one smart column execution. Static columns, schema changes, row reads, and MCP tool calls do not count as ops.
  • When you exceed your plan ops, smart column runs pause until you upgrade or until the next monthly reset. Reads and writes continue. We never auto-charge overages without explicit opt-in.
  • Refunds: monthly plans are not refunded. Annual plans are refunded pro-rata for unused months on request within 60 days of payment.
  • Prices may change with 30 days notice. Existing annual contracts are honored at the original price for the remainder of the term.

5. Acceptable use

  • You may not use Hypertab to: send unsolicited bulk email or SMS (spam), scrape sites in violation of their terms of service, engage in fraud or money laundering, distribute malware, harass or threaten people, or violate the rights of third parties.
  • You may not use Hypertab to compete with Hypertab itself — for example, building a hosted active-table service on top of our infrastructure.
  • You may not benchmark or stress-test the service without prior written consent. Reach out at [email protected] for permission.
  • AI smart columns: you are responsible for the prompts you send and the outputs you act on. We do not review or moderate AI outputs.
  • We may suspend accounts violating these rules with notice. In severe cases (illegal activity, active threats) we may suspend without notice.

6. Your data

  • You own your data. We claim no rights to the tables, rows, columns, prompts, or outputs you store in Hypertab.
  • You grant us a limited license to process your data solely to operate the service for you (run smart columns, deliver webhooks, sync in real time, etc.).
  • We do not train AI models on your data.

7. Hypertab intellectual property

  • The Hypertab name, logo, and brand are owned by Hypertab AI, Inc. You may not use them without permission, except to factually identify Hypertab as a tool you use.
  • The Hypertab software, API, MCP server, and documentation are protected by copyright. The MCP server and Workers code are source-available on GitHub under a license that permits inspection but not commercial redistribution.

8. Third-party services

  • AI smart columns require an API key from a provider you choose (OpenAI, Anthropic, Google, etc.). You are billed by that provider directly. Their terms apply to their portion of the work.
  • HTTP smart columns and webhooks call URLs you specify. You are responsible for ensuring you have permission to call those URLs and for handling responses correctly.
  • Hypertab is not responsible for outages, errors, or charges from third-party providers you integrate.

9. Disclaimer of warranties

  • The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected immediately.
  • You use AI outputs at your own risk. AI providers can produce inaccurate or harmful content. Verify critical outputs before acting on them.

10. Limitation of liability

  • To the maximum extent permitted by law, Hypertab AI, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
  • Our total liability for any claim arising out of these terms or the service is limited to the amount you paid us in the 12 months before the claim arose, or USD $100, whichever is greater.
  • These limits apply even if we have been advised of the possibility of such damages.

11. Termination

  • You may close your account anytime in settings. Your data is deleted within 30 days per the Privacy Policy.
  • We may terminate accounts that violate these terms, with notice except in cases of severe abuse.
  • On termination: paid balances are not refunded for monthly plans; annual plans are refunded pro-rata as described in section 4.

12. Governing law and disputes

  • These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
  • Disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in English in Delaware.
  • You may bring claims in small-claims court instead of arbitration if eligible.
  • Class actions are waived. You may bring claims only in your individual capacity.

13. Changes to these terms

  • We may update these terms. Material changes will be announced by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
  • Minor changes (clarifications, typo fixes) take effect on publication and are reflected in the "last updated" date at the top.
